I think it's more convoluted than that, most everyone is confused about the IP ownership, and licensed rights given to NNVC are far more uncertain than most people realize.

From the USPTO, we know that the patents are assigned to AllExcel. They own the patents, and not anyone else.

Then from one of NNVC's unclear PRs, we have this:

The patents have been assigned to AllExcel, Inc., the Company at which the ground-breaking work was performed. AllExcel, Inc. has contractually transferred this intellectual property to TheraCour Pharma, Inc.

"contractually transferred" is nonsense. The Assignee is AllExcel. An assignee of a patent can't "contractually transfer" its assignment. That has to be done through the patent office. And the patent office shows that AllExcell is currently the assignee.

What we have to infer is this:

- AllExcel, the owner of patents, licensed some rights to TheraCour, including (presumably) the right for TheraCour to sub-license some part of their rights.

- Then TheraCour did some type of sub-licensing of some portion of their rights to NNVC.

- But AllExcell is still the owner (assignee) of the patents, and nobody has a clue what rights they gave to TheraCour in some type of licensing agreement.

NNVC is a sub-licensee, through Theracour, to some rights to do something with claims in patents owned by AllExcell.
