Yes its pretty standard language often used when increases are needed. The only difference I see here is them stating the need for funds to pursue any potential remedy from Rontan for terminating the deal. I suspect Rontan had discussions with counsel before deciding to terminate, so they have a reason or reasons whether valid or proper it looks like a Judge will decide
