But the transfer of a non transferable licence doesn't just require notice, it requires permission. This all may be moot in that the party that would have to object (HP) does not appear to object. If as you say DFMI shareholders agreed as well, then they have no basis to object either that the undertaking was transfered out, or so it seems.
If this is all true, then it does appear that resistance to the declaratory judgment over the ownership of VDK 2 appears futile.
