My question involved a plaintiff appeal. But yes, if gvt appealed, they'd probably want to keep the secret documents secret. Would they risk those documents being exposed in any appeal process? And if so, perhaps it's less likely that they would appeal in the event of a plaintiff victory. But then, there are so many suits going on, it's hard to even imagine the game theory at this point.
