The day after Digital filed its original complaint, its representative contacted TASER to suggest that TASER should purchase Digital’s law enforcement division. That correspondence, and TASER’s response, are attached hereto.5 Filing a lawsuit to try to jump-start acquisition talks is not a proper use of the judicial system. This is particularly so when the lawsuit is deficient on its face. After TASER refused Digital’s initial overture, Digital doubled down by filing the First Amended Complaint and including its non-patent claims. Those allegations involve a hodge-podge of hearsay media statements that Digital takes pains not to adopt itself, and that contain no accusations of “conspiracy” or “bribery” by TASER.
