I would think that trying to circumvent an IRS lien by directing Kosmos to pay CEPSA directly would not be looked upon favorably by the IRS or CEPSA. CEPSA would risk that the IRS takes the funds back and ERHC would risk being charged with tax avoidance.

Perhaps if ERHC could structure a farmout agreement which included CEPSA and Kosmos and which included a payment to the IRS it might work. But if I were any of those 3 companies I would not do anything without getting the OK from the IRS first. Too much risk to do it any other way until this is settled.
