Stockmedic, not that I am the biggest fan of SMME but I can tell you, just because a Plaintiff loses a case it does not automatically follow the winner gets costs awarded in their favour. The Plaintiff basically to some degree only has to show the court the claim was genuine, not frivolous and that it had a chance of succeeding. In other words brought in good faith with a reasonable chance of winning.
Costs are generally only awarded when the claim is rubbish and should not have been brought before a court.
