You're missing something important Doc. Being as astute as you are, you would have noticed that the recent press release was referring to an APPEAL against an earlier judgement against MC with regard to the awarding of costs in the litigation. In other words MC persisted in their attempts to have costs awarded against Smartmetric after failing initially. The judgement at that time also highlighted a view by the court that Smartmetric should probably have won. Look it up. It's all there.
Also, do you think it's really possible that the defendant would not pursue costs against a plaintiff in an 11 billion law suit because they were feeling sorry for them or something? Wow......
I think a more plausible explanation is that MC were trying to crush the company by saddling it with a debt that would be crippling given the state of finances overall.
So far from being misleading, it might be an idea for you to get the facts straight.
