First, you have provided absolutely no evidence of any "illegal shorting" of SPNG. Ever. I've read all your 'letters to DaJudge' and all your posts on iHub and they contain exactly zero evidence of any 'illegal shorting'.

Second, even if - for the sake of argument - some 'illegal shorting' took place, that does not change the fact that SPNG shareholders bought into a pure SCAM that had zero underlying value as a business. So the ONLY claim the shareholders have is that the alleged 'illegal shorts' more quickly exposed the fact that the shareholders had bought a pig in a poke and thus frustrated their ability to sell fundamentally worthless shares in a scam company to others.

That is exactly what the argument boils down to. Exactly.

SPNG shareholders ONLY claim is against Metter and Moskowitz for defrauding them regarding a pre-planned securities fraud scam using a concocted, non-viable business and false financials and promotional statements.

Otherwise, the claim must be that SPNG shareholders feel they should have been given the opportunity to dump their poor decisions to buy shares in this scam company onto others. That means they want an ability to defraud others by selling the shares in a worthless company that they bought and later regretted.
