I would note that some of the most successful companys today started as penny stock, went through the trials of toxic financing and struggling with their company's finances, etc; it's just the nature of the high risk start-up penny 'beast' that has to constantly overcome the negatives like the constant shorting hedge funds and all the other daily dynamics they face.

Each investor has to decide if a portion of their portfolio is worthy of being in a high risk penny stock and then in an area undergoing dramatic changes and legal challenges.
