#310224 RE: emdyal #310216

Culpability and criminality are two different things. Being responsible for ERHC's dismal performance doesn't mean his actions were criminal in nature. I do believe he has violated MANY civil statutes such as late filing of Form 4. And failure to disclose certain material events with related parties. And failure to disclose the CDs on a timely basis. I also think his performance is indicative of incompetence. I just don't see any of that as criminal in nature at this point. Maybe that will change. What I do know is if this thing falls completely apart the shareholders who have adamantly supported his actions will be the first to turn on him with a vengeance. They will likely sue and try to recoup something. But they likely won't succeed. You can't squeeze blood out of a turnip.
