It isn't difficult to obtain a licensing agreement with almost any major company - they will put in terms and conditions in the agreement.

They aren't putting any money in the deal - if it is successful they get another revenue stream.

Most of the licensing agreements I have seen has a minimum "royalty" payment and if that isn't met - the agreement is in default and canceled.

So Crayola or M&Ms doesn't have anything to lose.
