SRPT SRPT lost an interference decided by the PTOBI to BMRN. I thought I said that the market minimizes any importance of the citation I gave. You agree in different words.
You did not read what I said in my post, nor the citation.
An unanswered question is whether the product of SRPT, if and when approved by the FDA, will be dominated by any claims of patents held by BMRN. Note the discussion of the patent battles ongoing between SRPT and BMRN in the U.S. as well as Europe.
Any question of settlement of that litigation, or result of any appeal to the Fed.Cir., or trial de novo in the District Court, also remain unanswered. Nor is there information presently in front of us whether SRPT holds any licenses under BMRN's patents, if necessary.
