I’m sure many of us have wondered the same thing relating to the broader implications of this lawsuit. Though it’s not a really big case in many respects, it directly deals with the theft of US intellectual property by a Chinese company. These things don’t exist in a vacuum, and Kaplan HAS to know the significance of this case in the broader “war” that has been declared against the USA-company Vringo by Chinese-company ZTE.
The absolute refusal (couched in always-respectful words) of the Chinese to play by US and international rules of litigation will have to be met and dealt with by SOMEBODY. ZTE continues to sustain legal losses in various countries, but has not had to pay the price in any meaningful way. The US Chamber of Commerce, the President, the US Congress, and many others have all complained about the Chinese, who are basically uncontrolled outlaws in the area of intellectual property theft, but nothing really changes (Hey, ZTE lost thirteen (13) times in Romania, and everybody acts as if nothing happened, and ZTE is an international choir boy. Nobody slaps ZTE down hard. Talk is cheap, but who has the guts to deal with an international bully?
Just maybe Kaplan will. ZTE has certainly been handled with kid gloves internationally.
