That's easy and not even improper on Kim's part. He is a follower on Seeking Alpha of a number of writers who have been known to write articles that expose potential defendants, whether the allegations made against them on SA are legitimate or not. It's just good research by Rosen Legal.

What they did, however, and it could end up being a big problem for them, is raise the prospect of Mr. Mako being called as a witness. That could be done by either party, ASSUMING his identity could be confirmed, and if the people here are right about the weakness of his science it may not go well for the plaintiff. I'll bet that they are happy to bring their case based on what he said and maybe a lot less happy at the prospect of having him on the witness stand. They end the claim period on the date of his article, when Mako reveals what they are alleging is the truth (theoretically buyers after that point can't file a claim because they were then fully informed), so they can't very well just ignore him and confine the issues to what they are portraying as the facts of the case. Although they seem to be trying VERY HARD to do that. The Complaint makes reference to the "Seeking Alpha Report" five times, yet there is no mention at all of "Mako Research" or even the word "author". Frankly if I was seeking Alpha I might be tempted to make a stink about the implications of Rosen using the phrase "Seeking Alpha Report" as if they were the original source of the allegations.

Mr. Mako may have to get ready for his little shit storm to have some blowback.
