the person perpetrating it knows to be false before he starts, not one that just does not work out.

That works quite well as a definition of a scam. With Pops, the convicted racketeer working as a "consultant", and Junior running the show, it is quite obvious that your definition is right on.

Actually most scams start where the Scammer simply doesn't care whether the activity is false or not....they would actually like it to be true, it's just that it is not the important issue. The "Falsity or truth" is not even a consideration.

Scammers say anything and take no responsibility for their statements. That is the definition of BAYP.

I say it is an activity that the

person perpetrating it knows to be false before he starts, not one that just does not work out.

That's close. Let's add in they not only know it's a scam, but later claim it just didn't work out. Well, how would a scammer do that?

In the case of BAYP you start as a mining scam. It just didn't work out. So it's time for a dip into the hemp oil business, plugging into the MJ microcrap craze of 2014. No revenues? It just didn't work out. Time for an oil scam. And when plugged oil wells don't quite "work out", then bring in Shameberg for a JV, and imaginary funding from LeRoy. Once past the Feb 2016 P&D if things don't "work out" there's always Bitcoin, or a loop back into the MJ craze. Almost has a random flavor to it.

Then again it does "work out" for Porter. He gets to dump stock into each P&D along the way. Too many shares in the O/S? Too low a PPS? No problem, perform a 100:1 R/S, and start anew.

Porter is just a plain vanilla scammer. And in the microcrap market there's nothing illegal about being a scammer. As long as he doesn't violate Rule 144 during the dump, or go over the cliff into criminal activity, he can play the scam game for many years. Traders can try to pump or not while trading. Pie eyed "investors" get screwed. Porter dumps paper for a living, for as long as he can make it last. What a happy ending.
