That was to my point yesterday. He was pretty specific in his wording, worse it was used in teasers to get people to subscribe to his high priced newsletter, and now it appears to be suspect. I can easily see an individual or a class go after him if this reco goes in the tank. He can't argue volatility as he put it in his own words, and now it appears that he misrepresented something material that may have induced investments on the part of individuals. I don't see his disclaimer getting him out of a misrepresentation like that, if he did misrep it.
