What I see is that the challenge for the Gov may be how to face the 'FnF situation' from what we think as the 'truth'... and justice from a legal and constitutional aspect "without losing face" and appearing less powerful. Is there any such comparable precedent from previous history?

Gov normally regards itself as being on 'higher level'... one that dictates and 'enforces' the laws using the Courts and the Justice system and the "laws" of the land.

It appears to me that here we have a totally 'new situation' that it calls for a role that can be a difficult challenge for the Gov. A tough 'dilemma' requiring them to act as one of 'accepting failure/misapplication' of the "laws". The latter requires a 'behavior' and 'role' that the 'arrogance of power/ruler' would hardly want to be even seen to have been forced into it by any Plaintiff and/or even pushed into it by another branch of government!

Another question would be if the Courts and the Justice system have the courage to apply the 'laws' leading them to go against the Executive Branch... without the Gov/Exec.Branch claiming executive privilege? Interesting and uncommon questions for the powerful Executive branch.
