What do you expect a suit like that to say -- "we think the people we are suing are charitable fellows and God's gift to the earth" ???

2. The suit is a derivative which means it was filed on BEHALF of PWEB. PWEB the company would get the proceeds of any victory to the benefit of shareholders and the stock.
"If the derivative action succeeds and damages are awarded, the damages ordinarily go to the corporate treasury for the benefit of the corporation. The suing shareholder is entitled only to reimbursement of his reasonable attorney’s fees that he incurred in bringing the action."
