MINIMUM legal burn rate for the next 18 months is $1.5M - and that is for a bare-bones defense. A week-long trial could easily cost over a million just by itself - not counting discovery, document production, depositions, research, motions, briefs, etc. BEFORE the trial date. If I had to place a realistic figure on the actual out-of-pocket cost for a defense through trial in this type of situation, $3M is a much more realistic 18 month estimate. Could run to $5M or more if there are contentious issues in discovery, multiple expert witnesses, lots of motions to argue in Colorado - travel time and expense.
