Its wasnt long ago someone posted the link to Advisory's claim it had $200 million in cash from profits and $1.3 billion under its control. I don't think these guys drank the money away. They wouldn't be fighting so hard to hand onto control if there was nothing in the till.

Good point but Advisorshares is fighting this losing battle to the end because they don't want to give up the staggering amount of money they are making off these ETF's. I'd like to see this settled before trial but it may be difficult because I don't think A/S wants to play ball. We shall see.
