like i read it, they only buying the shares 150mil from a debitor who haves convertible notes and that by the end of august, they not buying back shares from the market..... so this is going nowhere any time soon....

Anywho...in what context are you using "mutually exclusive"? That neither SUTI or the funder are tied together in a mutually exclusive fashion in the agreement???...if so, what does that have to do with the definition of a buyback???
