Don't be too sure of that. I suggest that you look into it further if you think it's important.
The 10-K has a table in it called Table 2: Intellectual Property, Patents, and Pending Patents Licensed by the Company and it does list as Owners:
TheraCour Pharma and Univ. of Massachusetts, Lowell. [Nonexclusive license from TheraCour Pharma].
and
TheraCour Pharma, Inc. [Exclusive License].

Actually I was unable to confirm that ownership. A search of USPTO.gov and https://patentscope.wipo.int/search/en/advancedSearch.jsf and portal.uspto.gov/pair/PublicPair seemed to show AllExcel as assignee where one was shown and I was unable to find where there was a subsequent assignment to TheraCour.

"AllExcel" only gets one mention in the 10-K:
"Anil Diwan, PhD, age 55, has been President and the Chairman of the Board of Directors of the Company since consummation of the merger on June 1, 2005. Dr. Diwan simultaneously therewith and since its formation, has also served as the Chief Executive Officer and Director of AllExcel, Inc. (from 1995 to the present) and TheraCour Pharma, Inc. (from 2004 to the present) and is the original inventor of the technologies licensed to NanoViricides Inc., as well as the TheraCour polymeric micelle technologies and products based on them."


This is a subject that is way above my pay grade and it needs more work, but it is not clear to me that TheraCour owns the patents that the 10-K says it does.

As far as I know, NNVC still owns the license for this world patent. There are still 9 years remaining plus whatever extensions are provided by the FDA, from 3 up to 7 additional years.
