#18017 RE: estboss #18016

TMM fought a long time to keep HP out of this but the judge finally saw it Dimensions way that HP was "necessary" to determine ownership and ordered TMM to serve them. So unless she changes her mind which is not likely she would have to say there is no 100% way to certify which company owns the VDK codec so nobody owns it. And Dimensions countersuit goes forward because TMM brought the case without being ready and having their proof in place.

The dfi dfmi merger would likely be a moot point but even if it wasnt I have already explained the legal use of estoppel which would award it to Dimension based on all the dfi and dfmi shareholders being told by the boards that dfmi owned everything and then the dfi board backing it up by filing their tax returns confirming that as well as cancelling 100% of the dfi shares and issuing the shareholders including Simpson and Haskins dfmi shares.

TMM paid Simpson and Haskins in 2012 knowing they were crooks and did not own that license and it is not a difficult thing to prove.

There are NO outs for TMM in this mess they have created for themselves.
