estboss I have no problem explaining this again its an important point. Nobody disputes that HP is the successor to the line of companies that started with Iterated. But do they have a clue where all the old Iterated records are from 1993-2000? Maybe so maybe no and how hard to they really want to look?
If they find nothing or choose to only take a cursory look for them then they would have to report back to the court that they have no idea who the legal owner of the VDK 2.0 license is or the earlier licenses.
That is a major problem for the judge as she would likely have to declare TMMs complaint void. She will also declare that TMM should have had confirmed HP proof of their insane version of history in advance so while their case is tossed the countersuit by Dimension stays in place.
Strong possibility that is how this goes. But there are no successful alternatives for TMM. Should she let this go to trial then the old Iterated Presidents will be testifying for Dimension that TMMs version of history is total BS. Not to mention the mountain of evidence that crushes TMM.
