I don't consider a phone conversation with a pinky CEO to be reliable DD. And we've witnessed here on this board where apparently McHenry told someone something then never followed through. Reliable DD is in filings.... You can't hold the CEO accountable to phone call.
I agree with SUNY. File the attorney letter from last annual report before moving forward.
