The SEC sends out letters via US Post Office "Certified". Eddie signed for the certified letter on September 19, 2014 and chose to ignore the warning.

On
September 16, 2014, the Commission’s Division of Corporation Finance sent a delinquency
letter to SMKY at the address shown in its then-most recent filing in the Commission’s EDGAR
system requesting compliance with its periodic filing requirements, which SMKY received on
September 19, 2014. To date, SMKY has failed to cure its delinquencies.

In addition, Eddie was seriously delinquent and attempted to cure its delinquencies which included a discussion with Enforcement as to a timeline. The ALJ will not accept his word this time around.
