HP will be able to substantiate that the deal with DFI was never completed because it called for DFI to issue 5% of its stock to Iterated and they could not due to being an S corp..

However they will confirm that DFMI was able to issue them the 5% stock and receive an actual legal license. Since every person was moved from DFI to DFMI with the same number of shares there was no reason for anybody to care at the time.

Pretending that DFI had any rights to that codec years later is ridiculous, as the jury will find out.
