I don't think Nasdaq accepts a R/S to bring over the limit, that would only add to the death spiral. The only way they can recover would be to make a settlement w/ SDVI and have them participate in their recovery, as per preferred share holders. And public apology, maybe even a share buyback as a public apology to their share holders. IMO
