Did anyone file a lawsuit on this? Sure it's a penny stock but I'd guess there's a whole lot of money tied up here. Once the company hears "class action" i would think they'd be interested in figuring out how to resolve this.
As far as I could tell the stock was used by the company at an earlier time. They just stopped reporting and let the shares continue to trade.
If they failed to mention it to Tesla it isn't the fault of the investors. They shouldn't be the loosers here. If anything, the stock should have been closed down by the company. Either way it's still the responsibility of the company.
