Great question. I am not exactly sure. I am not a lawyer. However, penny or not, when is ok for any business that issues stock to misrepresent itself w/ potentially misleading statements about the company. Many investors have tried repeatedly to contact company to get updates and to the best of my knowledge not one single person has had a reply of any kind.
