I haven't heard anything about a R/S but this BK deal sounds a bit like what USU did. 8% of the company will be returned to the existing shareholders after the recapitalization date unless a better offer comes along. Which is almost guaranteed not to happen and I do understand your point about staying away from this. However for the more experienced traders this could be a very hot short term play in the near future.
