Market Makers are legally allowed to process trades before locating and delivering each share traded, but they are expected to complete the buy and sell as a settled trade as soon as practical. Until the transactions are settled, the unsettled trades are considered Naked Short Sales - and this is temporarily permitted by the SEC. Naked Short Sales are not illegal, only abusive Naked Short Sales are illegal.
