I think it would be fair...safe and pretty obvious to say that using a public msg board to make legal matters public isn't going to happen especially if it's a pending investigation. That would hold true if you asked the CEO as well. I expect no comment is appropriate until a council approved statement could or even should be released. Just an opinion but seems pretty logical though.
