You are confused green. Unless you can show in the loan documents where newco is collateral.
You can not because they do not say it and Newco is not collateral.
Take it from somebody who knows, understands, and can back it up...
You cannot document your claims with proof. I can.
A requirement for Newco to be collateral is for the loan documents to identify Newco as collateral. They do not, therefore Newco is not collateral.
It is nice that facts can be proven or disproven, and they trump uneducated opinions.
