do not fully understand the part on if we win we do not win

more importantly I do not see where they are appealing

my thoughts were that the plaintiffs (equity) would file briefs on why the Judge was wrong to say HERA does not allow and the ripeness issue

these appeals seem to be arguing at the appeals court the same arguments as at the district court

that confuses me
