Yes, that's because Rico is trying to back date the effective date of the amendment in order to cover his tracks.

He needed for the amendment to be effective BEFORE the transfer agent had issued more shares outstanding then authorized. This occurred when he duped the TA by not sending him the amendment from the a/s reduction.

Now that will be impossible and will be more ammunition for the SEC.
