Daniel Boon,

There's something that you be missing or unaware of.

ZTE has been very aggressive in applying for patents for the past few years.
They appear, from my limited vantage point on the sidelines, to be emerging as an IP power house in their own right, particularly as it pertains to next gen 5G technology. They appear to have "gotten religion" when it comes to the IP wars and realize that they will be able to do others in the future what Vringo is doing to them if they play their cards right... I think the reason ZTE is making new highs is partly because "the street" is waking up to the fact that in addition to their dominant position in cellular infrastructure and ok position in handsets, they now have a very powerful third leg of the stool in IP rights for next generation tech. I'd go so far as to say that ZTE has no doubt wished they could just skip 3G/4G in those markets where they have big licensing hurdles and go straight to 5G -- but they can't... The market isn't ready for that yet and they can't gamble on that and lose share in 4G if they're wrong/too early.

That's partly why ZTE is so frustrated with Vringo being an NPE... They wanted to cross license their way out of this stuff but Nokia/Vringo figured out a work around and now they're coming to terms with the "gotcha" that's been in the works for years now...

This is all just opion and speculation on my part.
