In all honesty, whatever he does is overinterpreted. [I'm not conclusively saying that it's because he is black and Rs are racists, but that's one possible explanation.] I think one of the articles I linked is is correct that POTUS is happy to fight on this as he feels that he is on the right side of history. Section II doesn't have to mean excessive regulation and is pretty much the only way to do net neutrality given the existing statutes. And Scalia is probably right that it is well within the statute so will be upheld. In fact, given Scalia is one of the R votes on SCOTUS it's pretty obvious it will pass judicial review.

I do think the Rs are getting besieged by the cable operators and so on and probably can raise a ton of money from them. But, net neutrality is tremendously populist and popular for the obvious reason that it strikes people as being fair.
