I wouldn't think it's worth the possible cost's to launch at this point. I assume that all the inventory they had built up prior to last May's expected rollout is now in a landfill someplace so they'll have to create new product which could take a couple of weeks.
Considering Momenta's legal history I doubt they could even win a parking ticket lawsuit.
Do you think they would launch with patent dispute still unresolved and the risk of 3x damages?
Rick Shea at the Leerink conference intimated that they would NOT be assessed 3X damages if Sandoz launched at risk. Possibly - no assessment. See time line at 7:20 - 8:45 for Shea's interpretation -
