They are battling this to the death. You can see they were so desperate to even file for a summary judgement which means the facts aren't in dispute. Fund, the plantiff would be the ones to file a summary judgement, in which they did BUT Advisor Shares also filed a summary judgment which is extremely rare for any defendants to file such a motion. As to buying shares, there are hardly any shares that are significant enough for anyone to pick up now. It's also peanuts compared to what is at stake for A/S.
Looking at the 13g's Knight owns 168,430 shares for 19.41% of Fund another entity of BE Capital owns 94,640 shares for 10.91% of the company. There Is at least one other person who owns 5% of Fund but isn't showing through a 13g yet.
