#345159 RE: scion #345157

Scion: Thanks for posting this affidavit from Charles Davis in SEC Enforcement:

Doc 142 PDF file
http://www.scribd.com/doc/120315851/SEC-v-Spongetech-Doc-142-Filed-13-Apr-11

This document lays out a bunch of shady transactions between Metter/Moscowitz and a half-dozen "Spongetech affiliates". This is how M&M orchestrated their illegal sales of improperly registered Spongetech stock, explained by Charles Davis with the SEC. It's hard to know just how involved and how much "in the know" these affilates were, but it's pretty clear that they had previous connections with M&M and at a minimum "looked the other way" as they pocketed profits from Spongetech scam by facilitating transactions with these bogus shares. THIS IS THE ONE AREA WHERE THE SEC & DOJ REALLY DROPPED THE BALL. THEY SHOULD HAVE SQUEEZED EVERY ONE OF THESE AFFILIATES, OFFERING IMMUNITY TO ANYONE WILLING TO TESTIFY AGAINST M&M.

Note that NONE OF THIS has anything remotely to do with "Illegal Naked Shorting". There continues to be NO PROOF whatsoever that has been posted that demonstrates this occurred. Legal Short Selling - Absolutely. Illegal Naked Short Selling of SPNG - No. IF YOU HAVE IT - POST IT!
