The final order that can be appealed is the order of summary judgment. The dismissal is collateral to that. I would think this order is material enough to be an 8K event, but MMR is loose with SEC rules.

Doctrine of res judicata applies to bringing a new suit on the same issues. Appealing the current suit is totally different. The time for filing for appeal is very short. I presume a bond might be required if MMRF wants to drag this on. And the Fed judges won't be amused.
