You are also discounting the the results of two Markman hearings on claims construction that both went almost completely GERS way; so much so that the defendants filed a a Writ of Mandamus to the Appellate Court asking for a change of venue, stating that they could not get a fair trial in this one. It is little more complicated than you imply.
