This is a Tijuana "company" (sure, "greater" San Diego area which is right across the border) with 1 employee. He does not need to fool around with US bankruptcy. Not sure how they keep selling worthless paper ("shares") in our OTC markets, but their whole on going scam is a perfect example of how rotten our pink sheet market is. The SEC could care less.
