I have pulled the most recent court documents filed on 12/9, 12/11, 12/12 and...

From what I can tell at a glance, the complaint seems pretty bogus to me, but also the fact that there is one tells me the business is still alive and well.

The complaint centers around "damages (to a franchisee) resulting from lost profits and other problems with the business".

The plaintiff filed a motion to quash as recently as Dec 9th, 2014 because a material witness on the plaintiff side is unable to testify during business hours on a certain future date given under defense counsel subpoena. I'm no legal expert, but I doubt it is a good sign that a plaintiff feels compelled to file this sort of motion. If the complaint is legitimate, then the plaintiff should have no issues with the deposition of a material witness in Airtrona's defense as it would only serve to strengthen the plaintiff's case. In my opinion, this sort of motion is an attempt to hide potentially damaging testimony that could render the plaintiff's complaint invalid.

Sounds to me like the plaintiff probably paid the franchise fee and then later decided the business wasn't for him/her, and then decided they wanted their money back.

News-bite for all - Franchises do NOT come with management teams and clienteles. If they did, they would be much more expensive! They typically come with any necessary equipment, some sort of corporate support network and learning materials, but the Franchisee is ultimately responsible for managing the day to day business and building his/her own clientele.

I will keep monitoring Lawsuitdata.com and will notify this board when I see a judgement filed in this case.

By the way, I have a cousin here in Texas that recently bought an ozone franchise with Enviroclean, and is doing well targeting apartment complexes, daycares, and autos. The business building process is not a walk in the park... it requires lots of communication and free demos. He did a free demo at our Thanksgiving gathering, and completely removed the odors from an old stale-smelling car. So now I have seen two very different accounts of how ozone sanitizes with my own swimming pool and with automobile applications.

On a separate note, today marks the 45th cut off day for ARTR Q3 financials... it would be very nice to see both Q2 and Q3 reports out today. And ditch that pretty red stop sign.
