THE TRIAL DATE
Plaintiffs Genentech, Inc. and Tercica, Inc. move to modify
the Case Management Order to advance the trial date from November
6, 2006, to a date in early September. Defendants Insmed
Incorporated, Celtrix Pharmaceuticals, Inc. and Insmed Therapeutic
Proteins, Inc. oppose Plaintiffs' motion. The matter was submitted
on the papers. Having considered the parties' papers and oral
argument on the motions, the Court denies Plaintiffs' motion.
