NEWL LIED on Several issues.......about shipping the coal,providing False shipping schedules,providing False SGS analysis of coal THEY DID NOT OWN.

And there's a lot of ''Harm'' when you have a contract and you lie and falsify documents.

$1 million up front to cover the cost wasn't alot considering it was $6 million worth. ... The timing just didn't work that would have kept NEWL on nas....

Newlead clearly stated its annual report that it had contracted to purchase coal with which to fulfill startup supply business with this resource. It is irrelevant where the coal comes from as long as a supply contract gets fulfilled. It is not irrelevant, however, whether the purchaser actually has a bank letter of credit with which to pay for the coal delivery upon execution.

That is where the ultimate decision is headed for an eventual ruling.
