He must file. Every day that goes by is a date closer to a revocation pursuant to Section 12(j) of the Exchange Act. Which means "symbol not found".

Either he committed fraud and does not want to be audited, or he has no money for an audit.

Neither is good. He has been delinquent for a long time. That is either a lot of fraud, or quite some time with a lack of capital.
