News Flash: No One was attracted to this because of a "Dividend"!

The legal issue is not, "Who was attracted", rather, what was the intent. E.g., a bank robber still faces criminal charges even if he botches the attempt.

The decision on buying this stock or any stock for that matter is a risk. When it comes to compliance of publicly traded securities and especially dissemination of information from the company this is a whole different matter.
